Following with the same matter I discussed last month on the obligation to declare world wide assets by Spanish residents and as I mentioned on last month’s article, this newsletter is going to discuss who is considered a tax resident in Spain.
Are you aware of the obligation to declare worldwide assets and income by Spanish residents?
I have receive a couple of queries and calls about this current issue and I thought that some insight was needed. I have, therefore, asked Mr. Juan Antonio Espinosa, tax advisor, to write this article to try to clarify the actual situation.
Is the fall in the prices going to stop? What the experts say?
It should not be this way but I have found complete opposite opinions. On one side JP Morgan said that the prices are close to reach the bottom but on the other side I could read an article about one month ago on The Telegraph stating that “Spain’s house prices to fall another 30pc as gluts keeps growing” with “relentless slides” until 2018.
The first opinion, from JP Morgan, is based on the fact that banks are more realistic when fixing the prices of their properties and refers to cases where complete developments have been sold in a couple of months. By being realistic, they are able to sell and, therefore, the stock will be reduced. Spain is a country for buyers where opportunities are arising and exterior investors will lead the recovery.
On the other side, The Telegraph refers to the comments of one the Spain’s top consultants, Mr. Fernando Rodriguez Acuña, saying that the stocks of properties are not being reduced and, therefore, prices will have to be reduced even more in order to reduce the actual levels of stock. He said, and refers to our area: “We think that prices will recover in the traditional coastal areas like the Canaries or Malaga within five to eight years, but for now banks are offering huge discounts and nobody is calling. Marbella has already fallen by 50pc and prices are going down and down”.
Who is correct? I have to say that I do not know. There are still so many uncertainties that may affect the market that, in my modest opinion, it is really difficult to predict the future. What I truly see are continuous ups & downs in our market.
It is time again to talk about the prices
Every three months we get the information from the Ministry of Housing expecting that the fall of the housing prices in the area will end and that we will get to the inflexion point and stabilization, and, maybe, increases. However, and again, it has not been this quarter.
Taking a look to the chart, we can see that the prices in Estepona are still falling dramatically and that those of Marbella are much more stable but with a downward tendency. We see here the same effect that in previous quarters. The owners of properties in Estepona have to reduce their prices much more in order to compete with the every day more competitive prices of Marbella. The gap is every month wider.

Where and What was sold in 2012
When you analyze the information provided by the Ministry of Housing you always find something interesting and in some cases surprising. This month I am going to study, with the information for the whole Malaga province, Where and What type of properties were sold up to the third quarter of 2012.
“Where” can be seen on the following chart and it did not surprise me. The Council with more sales is Malaga city followed by Marbella, the two biggest councils of the Costa del Sol. What it is interesting is to see how spread the percentages are among the councils taking into account the different sizes of each municipality and to confirm that these councils have one common characteristic: all of them are coastal.
I have divided the “What” in the type of property and the purchase price. Most of the properties that sold during the first three quarters of 2012 were apartments with prices below the 300.000 € figure. In that range, it is remarkable that 63% were priced below 150.000 € a figure somewhat low for the market of Marbella and Benahavis but it is important in other markets of the province. On the other side, it is also remarkable that, and I commented the same some months ago, only less than 2% of the sales were of properties priced over the 600.000 € barrier. Most of the luxury properties are here.
RE/MAX Spain published the results for 2012
We have again been the best office of Andalucia. RE/MAX Eralia ranked number 1 as the best RE/MAX office of Anfdalucia. My results were also quite good as I have mantained my position as one of the top ten Associate Agents of Spain (among 500 agents). I always say that hard work, professionalism and honesty will drive you to success.
Villa Anna in two of the main Newspapers of Spain
We have been able to publish brief reports about this elegant property I am marketing on two of the main newspapers of Spain: El Pais and Diario Expansion. It is always the same goal: maximize expousure. It is not only the potential clients that it may generate but also gives the property the plus of being selected among a number of candidates.
